Amendments to OL 8/2007 by OL 3/2015 affecting the expenditure ceiling regulated in OL 5/1985.

ARTICLE 17. INFRINGEMENTS AND 17 BIS. SANCTIONS

VERY SERIOUS:

The exceeding by political parties, by 10% or more, of the limits on election expenses provided for in Organic Law 5/1985 on the General Electoral System, notwithstanding the provisions of Article 134 of said Law.

Sanction: A proportional financial penalty of two to five times the amount of the overspending. The penalty shall not be less than EUR 50,000.00.

SERIOUS:

The exceeding by political parties, by more than 3% and by less than 10%, of the limits on election expenses provided for in Organic Law 5/1985 on the General Electoral System, notwithstanding the provisions of Article 134 of said Law.

Sanction: A proportional financial penalty of two to five times the amount of the overspending. The penalty shall not be less than EUR 25,000.00.

MINOR:

The exceeding by political parties, by more than 1% and by less than 3%, of the limits on election expenses provided for in Organic Law 5/1985 on the General Electoral System, notwithstanding the provisions of Article 134 of said Law.

Sanction: A proportional financial penalty of two to five times the amount of the overspending. The penalty shall not be less than EUR 5,000.00.
